Editor:
In response to a letter to the editor by Michael A. Scanlon on 5/13/2013, our non-partisan grassroots organization, Stop Stormwater Utility Association would first like to thank Mr. Scanlon for bringing more attention to this issue and helping our cause of raising funds for a potential lawsuit against the county to protect all citizens constitutional rights.
Second, we would like to correct him on some of his misleading and erroneous facts. Our organization is in fact set up as a fully functioning business with upstanding board members, legal meeting minutes and a registered Tax ID number with the IRS. We have very experienced professional legal representation, Mr. Sean Gallagher, of Polsinelli PC and his team in Denver, and we are in the process of researching exactly how and why the storm water utility program was set up, implemented and why it was imposed on the citizens without our permission.
We do know this: It shouldn’t cost the taxpayers an additional $500,000 annually just in staffing costs to operate a storm water utility.  Nor should the top 20 businesses in unincorporated Adams get taxed an astonishing $230,000 for storm water while their competition in the city of Brighton is getting a $1,200 bill. Yes, you read that correct, a $228,800 difference, that’s not a typo. And their competition in Thornton and Commerce City are receiving no storm water bill.  We believe setting up this program as a fee and not giving the citizens an opportunity to vote is in direct violation of the TABOR amendment to the Colorado Constitution.
Mr. Scanlon, we do appreciate your concerns, but throwing out a bunch of mis-information is not helping the citizens and business owners of Adams County.  If you have attended either of the BoCC meetings where there has been 350 to 400 citizens at each meeting, then you will have learned there are business members, farmers, ranchers, school teachers, union members, single moms, etc. all very concerned about the direction our county is taking with this storm water program.
Mr. Scanlon, we would invite you to log onto our website at www.StopRainTax.com, educate yourself on what is happening with our great community, and please make a donation.
We all need to work together if we are to make Adams County a better place to live and work.
